1. Definitions

• "Heron Cove," "we," "us," "our" — the senior residence operating at 45 Lakeshore Road East, Oakville, ON L6J 1H3
• "User," "you" — any person who accesses our website or submits an enquiry
• "Resident" — a person who has entered a formal residence arrangement with Heron Cove
• "Services" — the senior living arrangements and community amenities provided by Heron Cove
• "Agreement" — these Terms & Conditions, along with any separate residence agreement signed by a resident or their authorized representative

2. Acceptance of Terms

By accessing this website or submitting an enquiry, you confirm that you have read, understood, and agree to these Terms & Conditions. You must be at least 18 years of age and have the legal capacity to enter into agreements. If you are acting on behalf of another person (such as a family member), you represent that you have appropriate authority to do so.

3. Description of Services

Heron Cove provides non-medical senior living arrangements in Oakville, Ontario. Our offerings include three residence arrangements: the Seasonal Stay Experience, the Year-Round Community Residence, and the Couples' Companion Suite. Services include communal dining, social and recreational programming, housekeeping, and non-medical staff support.

Heron Cove is not a healthcare facility and does not provide nursing, medical, or personal care services. Residents are responsible for their own medical care and healthcare arrangements.

4. User Responsibilities

When using our website or interacting with Heron Cove, you agree to:

• Provide accurate and complete information in any forms or communications
• Treat staff and other residents with respect and consideration
• Not use our website for unlawful purposes or to transmit harmful content
• Not misrepresent your identity or authority to act on behalf of another person

5. Residence Agreements

Formal residence arrangements are subject to a separate written agreement between Heron Cove and the resident (or their authorized representative). These Terms & Conditions apply to website use and enquiry submissions; they do not constitute a residence agreement or a commitment to provide accommodation.

Availability of residence arrangements is subject to capacity at the time of enquiry and is confirmed only upon execution of a formal agreement.

6. Payment Terms

Fees for residence arrangements are stated in Canadian dollars (CAD). The current fee schedule is as follows:

• Seasonal Stay Experience: CAD $195 per day
• Year-Round Community Residence: CAD $485 per month (base amenity fee)
• Couples' Companion Suite: CAD $720 per month (base amenity fee)

Payment terms, accepted methods, and any applicable additional fees will be detailed in the formal residence agreement. Heron Cove reserves the right to adjust fees with reasonable notice, as specified in that agreement.

7. Cancellation and Refund Policy

Cancellation terms for residence arrangements are specified in the formal residence agreement. Website enquiries and visit requests may be cancelled at any time without obligation. No payment is collected through this website.

8. Intellectual Property

All content on this website — including text, images, design elements, and branding — is the property of Heron Cove and is protected under applicable Canadian intellectual property law. You may not reproduce, distribute, or use any content from this site without written permission.

9. Disclaimers

This website is provided "as is." While we make reasonable efforts to ensure accuracy, Heron Cove does not warrant that information is always current, complete, or error-free. Information on this website does not constitute professional legal, financial, or medical advice.

Heron Cove does not provide medical, nursing, or personal care services. Nothing on this website should be interpreted as a representation that such services are available.

10. Limitation of Liability

11. Termination

Heron Cove reserves the right to restrict access to our website for any user who violates these Terms. Termination of a residence arrangement is governed by the terms of the formal residence agreement.

12. Governing Law and Dispute Resolution

These Terms & Conditions are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved first through good-faith discussion. If unresolved, disputes will be subject to the jurisdiction of the courts of Ontario.

13. Changes to These Terms

We may update these Terms & Conditions from time to time. The "Last Updated" date at the top of this page will reflect any changes. Your continued use of this website after changes are posted constitutes acceptance of the updated terms.
